Cell Film Lawsuits begin across the United States

Another Copyright Plaintiff joins the fray

Cell Film lawsuit discovery has begun around the country in a new wave a cases from a new plaintiff.

“Cell”, the 2016 horror movie starring John Cusack (4.3/10 on IMDB and 2.5/4 from Roger Ebert) is now the property behind a new wave of copyright lawsuits that have been filed across the country. The plaintiffs demand copyright damages that total in the thousands of dollars from hundreds of defendants.

Like the “mysterious cellphone signal [that] transforms New Englanders into savage killers” in the film, the love of money seems to have transformed the Cell Film owner into participating in the wave of litigation stemming from bittorrent-based file-sharing.

And in Pennsylvania, the Cell Film case is before Judge Michael Baylson, the very same judge that held the Malibu Media Bellwether Trial – the same trial that set the stage for Malibu Media’s thousands of lawsuits in the past four years.

Eastern New York Malibu Media lawsuit discovery resumes; Motion to Quash denied

Malibu Media Lawsuits Resume on Long Island

Last October, Eastern District of New York Magistrate Judge Stephen I. Locke  stayed all Malibu Media lawsuit discovery pending the outcome of a Motion to Quash filed by one of the defendants.

That Defendant’s Motion to Quash has since been denied and the stay has been lifted as of August 23rd, 2016. Subpoena notices are already making their way to defendants.

Judge Locke cited all the usual reasons for denying Motions to Quash in Malibu Media cases.  The defendant isn’t the recipient of the subpoena, and therefore doesn’t have standing, and even if they did, that the subpoena is not an undue burden, and that defendant’s identity is not privileged or confidential information.

The ruling means that the Eastern District of New York is yet another forum that allows Malibu Media lawsuits to proceed far enough to encourage settlements.

Malibu Media lawsuits resume in NJ with 29 new cases

Malibu Media has filed 29 new federal copyright lawsuits after a five month hiatus. No, not a relaxing vacation for the largest filer of new copyright litigation in history. Rather, (allegedly) a long-brewing dispute over money became a sticking point between Malibu’s owners and their (now former) attorney, Keith Lipscomb. That dispute seems be mostly about Lipscomb’s representation and retention of client funds.

These new lawsuits mirror the same tactics used in the previous operation, demanding compensation for copyright infringement, not sharing or distribution, and accumulating at least a dozen infringements before suit.

Defendants in the newest of these lawsuits can expect to begin receiving notices of the subpoenas from their service providers shortly, in not already. These subpoenas seek the subscribers’ names and addresses. Plaintiffs typically use the identities to pursue settlements or further litigation.

Malibu Media resumes filing in CA, NY, and… Connecticut?

Malibu Media has filed 54 66 new federal copyright lawsuits after a three month hiatus. No, not a relaxing vacation for the largest filer of new copyright litigation in history. Rather, (allegedly) a long-brewing dispute over money became a sticking point between Malibu’s owners and their (now former) attorney, Keith Lipscomb. That dispute seems be mostly about Lipscomb’s representation and retention of client funds and makes for a good read.

With two remarkable exceptions, these new lawsuits mirror the same tactics used in the previous operation, demanding compensation for copyright infringement, not sharing or distribution, and accumulating at least a dozen infringements before suit. 31 suits were filed in the Eastern District of California and 21 in the Southern District of New York. These districts are likely the safest places to resume filing for their new firm, Pillar Law Group.

But then there’s two twelve new cases in Connecticut. These are the first two Malibu Media cases ever filed in CT, meaning that Malibu’s local counsel, Jackie James, is breaking new ground.

Defendants in the newest of these lawsuits can expect to begin receiving notices of the subpoenas from their service providers shortly, in not already. These subpoenas seek the subscribers’ names and addresses. Plaintiffs typically use the identities to pursue settlements or further litigation.

13 new Malibu Media lawsuits in Northern New York in April 2016

Malibu Media has filed 13 new federal copyright lawsuits in the Northern District of New York over alleged illegal downloading.

Malibu Media, owner of the adult entertainment website X-Art.com, has filed approximately 5,000 lawsuits in the last four years, and 433 so far in 2016. These newest 13 are just a continuation of that trend.

Defendants in the newest of these lawsuits can expect to begin receiving notices of the subpoenas from their service providers shortly, in not already. These subpoenas seek the subscribers’ names and addresses. Plaintiffs typically use the identities to pursue settlements or further litigation.

Malibu Media has filed 433 new federal copyright lawsuits in the United States in the first 97 days of 2016. The Plaintiffs make copyright infringement claims over alleged illegal downloading. 1,933 such lawsuits were filed in 2015. Broadcast Music, Inc. also known as BMI, comes in second for 2016 with 56 new copyright lawsuits.

Malibu Media, owner of the adult entertainment website X-Art.com, has filed approximately 5,000 lawsuits around the county in the last four years. These newest 433 are just a continuation of that trend.

Malibu’s attorneys recently lost 15 cases in California that were dismissed for failure to timely prosecute. Though this is good news for those 15 defendants, it is unusual for Malibu lawsuits to end in outright dismissal.

Defendants in the newest of these lawsuits will begin receiving notices of subpoenas sent to their internet service providers. These subpoenas seek the subscribers’ names and addresses. Plaintiffs typically use the identities to pursue settlements under the threat of further litigation.
